These Terms of Service apply to purchases made through the Kumara Shines website, kumarashines.com.
Please read these Terms of Service carefully before placing an order. They explain the terms that apply when you purchase products from Kumara Shines.
Nothing in these Terms of Service excludes, restricts or limits any consumer rights or legal remedies that cannot lawfully be excluded, restricted or limited.

2. PRODUCTS AND NATURAL GEMSTONES
Kumara Shines offers jewellery featuring natural gemstones and, unless otherwise stated in the individual product listing, solid 925 sterling silver.
Natural gemstones are formed by nature and may naturally vary in colour, tone, inclusions, patterns, clarity, transparency and appearance. These natural characteristics are part of the individuality of natural gemstones.
Because of natural variation, lighting, photography and differences between screens and devices, the actual appearance of a gemstone may differ slightly from photographs displayed on the website.
We take reasonable care to ensure that product descriptions and photographs accurately represent the products offered for sale.
Where a product is described as containing a natural gemstone, the product listing will provide the relevant information available to us about that gemstone.
Where stated in the individual product listing, a natural gemstone may be accompanied by a supplier authenticity certificate.
A supplier authenticity certificate is not an independent laboratory report or certification unless the product listing expressly states otherwise.
3. PRODUCT DESCRIPTIONS AND PHOTOGRAPHS
We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate and sufficiently clear.
Customers should review the complete product description and photographs before placing an order.
Colours and appearance may vary slightly because of lighting, photography and the device or screen used to view the website.
Where a product has a known imperfection, unusual characteristic or specific condition, this will be described in the relevant product listing where applicable.
Nothing in these Terms of Service affects your statutory rights where goods are not as described or otherwise fail to meet applicable legal requirements.
4. PERFECTLY IMPERFECT COLLECTION
Kumara Shines may offer selected jewellery through our Perfectly Imperfect Collection.
A Perfectly Imperfect item is a piece offered for sale because it has a known cosmetic imperfection or other specifically identified condition.
The relevant product listing will describe the known imperfection and, where appropriate, show it clearly in the product photographs.
Customers should carefully review the individual product description and photographs before purchasing a Perfectly Imperfect item.
The disclosed imperfection forms part of the described condition of that particular item.
However, disclosure of a known imperfection does not exclude or restrict any statutory consumer rights relating to a separate fault, misdescription or other matter that cannot lawfully be excluded.
Our Returns & Refund Policy applies to Perfectly Imperfect items in the same way as required by applicable law, subject to the disclosed condition of the individual product.
5. PRICES
All product prices are displayed in pounds sterling (£) unless otherwise stated.
The price payable for a product will be the price displayed on the website at the time the order is placed, subject to any obvious pricing error.
Applicable taxes and delivery charges will be displayed before the customer completes the purchase where required.
We take reasonable care to ensure that prices displayed on the website are accurate.
If we discover an obvious pricing error before an order has been accepted, we may contact the customer and provide the appropriate options available under applicable law.
6. PAYMENT
Payment must be successfully authorised through the payment method offered at checkout before an order can be processed.
By placing an order, the customer confirms that the payment information provided is valid and that they are authorised to use the selected payment method.
Available payment methods and any applicable payment options will be displayed during checkout.
Where a third-party payment provider is used, that provider may apply its own terms and conditions and privacy policy.
7. ORDERS AND CONTRACT FORMATION
When you place an order through the Kumara Shines website, you are submitting an offer to purchase the selected product or products.
After an order is placed, we will normally send an order acknowledgement or confirmation to the email address provided by the customer.
The acknowledgement confirms that we have received the order. It does not necessarily mean that the order has been accepted where further processing or availability checks are required.
A contract for the sale of goods will be formed when Kumara Shines accepts the order.
If we are unable to accept or fulfil an order, we will contact the customer as soon as reasonably possible.
If payment has already been taken for an order that we cannot fulfil, we will arrange an appropriate refund.
We reserve the right to correct obvious errors in product descriptions, prices or availability.
If an obvious error materially affects an order and the order has not yet been accepted, we may contact the customer to discuss the appropriate options.
8. PRODUCT AVAILABILITY
Our jewellery may be available in limited quantities.
Some natural gemstone jewellery may be one-of-a-kind or available as a single piece.
Product availability may change without notice.
If an ordered product becomes unavailable before the order can be fulfilled, we will contact the customer as soon as reasonably possible and, where payment has already been taken and the order cannot be fulfilled, provide an appropriate refund.
9. DELIVERY
We offer delivery options and estimated delivery information through our website and checkout.
For Kumara Shines UK delivery, the applicable delivery service, delivery charge and estimated delivery timeframe will be displayed on the website or at checkout.
Unless otherwise agreed with the customer, goods will be delivered without undue delay and, in any event, within the period required by applicable law.
Estimated delivery dates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, industrial action, disruption to transport networks or other events beyond our reasonable control.
Nothing in this section removes or restricts any statutory rights relating to delivery.

10. RISK AND DELIVERY
Kumara Shines remains responsible for the goods until they come into the physical possession of the customer or another person identified by the customer to receive them, except where applicable law provides otherwise.
Customers should inspect their parcel and jewellery after delivery and contact us promptly if there appears to be damage, a defect, an incorrect item or another delivery-related issue.

11. CANCELLATION AND RETURNS
For online purchases, consumers generally have a statutory right to cancel within 14 days of receiving the goods, without giving a reason, subject to applicable legal exceptions.
Where the statutory cancellation right applies, the customer must notify Kumara Shines of the cancellation within the applicable cancellation period.
After notifying us of cancellation, the customer generally has a further 14 days to return the goods.
The customer is responsible for taking reasonable care of the goods while they are in their possession.
Where goods have been handled beyond what is reasonably necessary to establish their nature, characteristics and functioning, applicable law may permit a deduction from the refund to reflect any resulting diminished value.
Where a valid cancellation applies, we will provide the refund required by applicable law, including the cost of standard delivery where required.
We may withhold reimbursement until we have received the returned goods or the customer has provided evidence that the goods have been returned, whichever occurs first, where permitted by law.

12. FAULTY, DAMAGED, MISDESCRIBED OR INCORRECT GOODS
If goods are faulty, damaged, not as described, not of satisfactory quality, not fit for their ordinary purpose, or the wrong goods have been supplied, the customer may have statutory rights and remedies under applicable UK consumer law.
Depending on the circumstances and applicable law, remedies may include repair, replacement, price reduction, refund or the right to reject the goods.
Nothing in these Terms of Service limits or excludes those statutory rights.
Customers should contact Kumara Shines as soon as reasonably possible if they believe there is a fault or other problem with their jewellery.
Please do not attempt to repair, alter or modify jewellery before contacting us where the issue may be a fault or damage, as this may make assessment of the issue more difficult.
13. DELIVERY DAMAGE AND CONDITION VERIFICATION
Kumara Shines carefully checks jewellery before dispatch and may maintain dispatch, quality-control and packaging records, including photographs or video evidence.
Where a customer reports that jewellery arrived damaged, defective, with a loose or missing stone, with a missing component, or otherwise not in the condition represented at delivery, we may request photographs, an unboxing video or other information to help establish the condition of the parcel and jewellery when received.

Any evidence or verification procedure is intended to assist our investigation and does not remove, restrict or replace any statutory consumer rights.
14. PERFECTLY IMPERFECT ITEMS AND DISCLOSED CONDITIONS
Where a specific imperfection has been clearly disclosed in a product listing before purchase, that disclosed condition forms part of the description of the goods.
A customer may not treat the disclosed condition itself as an undisclosed defect.
However, the disclosure of one known condition does not exclude responsibility for a separate fault, misdescription or other statutory consumer right.
15. REFUNDS
Where a refund is due, it will normally be made using the original payment method unless otherwise agreed or permitted by applicable law.
Refunds will be processed within the period required by applicable law.
For statutory online cancellation rights, any applicable refund will be handled in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and other applicable law.

16. WEBSITE CONTENT AND INTELLECTUAL PROPERTY
All original content on the Kumara Shines website, including photographs, product images, logos, branding, written content, graphics, designs and other materials, belongs to Kumara Shines or is used with appropriate permission or rights.
You may access and use website content for personal, non-commercial purposes in connection with shopping with Kumara Shines.
You must not reproduce, copy, modify, distribute, commercially exploit, republish or otherwise use Kumara Shines' original content without appropriate permission or a lawful basis for doing so.
The Kumara Shines name, branding and associated materials must not be used in a way that falsely suggests an unauthorised association, endorsement or partnership.

20. COMPLAINTS

We will consider complaints fairly and reasonably and will try to resolve them as promptly as reasonably possible.
Please provide your order number and relevant details so that we can investigate the matter.
Nothing in this complaints procedure prevents a customer from exercising any statutory right or legal remedy.
21. EVENTS OUTSIDE OUR REASONABLE CONTROL
We will not normally be responsible for delay caused by circumstances genuinely outside our reasonable control, such as severe weather, natural disasters, major transport disruption, widespread carrier disruption, industrial action, government restrictions or other events that could not reasonably have been prevented.
This section does not exclude or restrict any statutory consumer rights or obligations that cannot lawfully be excluded or restricted.
22. LIMITATION OF LIABILITY
Nothing in these Terms of Service excludes or limits liability where doing so would be unlawful.
Nothing in these Terms of Service excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms of Service removes or restricts statutory consumer rights relating to the quality, description, fitness, safety or other legal requirements applicable to goods.
Where liability may lawfully be limited, any limitation will apply only to the maximum extent permitted by applicable law.
23. CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our website, business practices or legal requirements.
The version applicable to an order will generally be the version in force when the relevant contract is formed, subject to any changes required by law or agreed with the customer.
Changes to these Terms of Service will not retrospectively remove or restrict rights relating to an order that has already been placed.

These Terms of Service are governed by the laws of England and Wales.
